General Terms and Conditions The Britankes.co.uk portal is owned by Medisoma.Ltd, legal entity code 13332396. This document represents an agreement (hereinafter referred to as the “Agreement”) between Medisoma.Ltd (hereinafter referred to as the “Portal Owner”) and you (hereinafter referred to as the “Visitor,” “Registered Visitor,” or “Service Provider”) regarding the use of the Britankes.co.uk portal.
The following terms are used in this document:

Portal Services: the services for searching and advertising services provided by the Portal Owner on the Portal;

Review: a positive testimonial (recommendation) or negative feedback (complaint) written by a Registered Visitor on the Service Provider Page about the services provided or agreed to be provided but not delivered by the Service Provider;
General Inquiry: a request submitted by a Registered Visitor on the Portal to obtain a specific service.
By using the Portal, you confirm that you have read and agreed to these Terms and Conditions (hereinafter referred to as the “Rules”), and you commit to abide by them. The use of the Portal, within the context of these Rules, encompasses any actions taken by you while browsing the Portal. By using the Portal in any way or form, you unconditionally and irrevocably undertake to comply with all the requirements set forth in these Rules. If you do not unconditionally and irrevocably agree to comply with all the obligations set forth in these Rules, you are not entitled to use the Portal.

Each Service Provider is considered a business entity using the Portal services for trade or business purposes unless otherwise stipulated by applicable legislation.
Rights and Responsibilities of Registered User:
By using any of the Portal’s services, the Registered User and Service Provider confirm that they:
Are 18 years of age or older, legally capable of entering into and performing the transactions offered on the Portal.
Will fulfill their obligations as specified in these Terms and Conditions.
Understand and agree that these Terms and Conditions establish only such legal relationships between the Registered User or Service Provider and Medisoma Ltd. as are directly and explicitly provided for in these Terms and Conditions.
Understand and agree that they are fully responsible for the information they post and publish on the Portal.
Will responsibly use the Portal’s services without posing any risk to the rights and interests of other Portal users.
Will safeguard their login credentials (username and password) and will be fully responsible for the confidentiality of this information. They understand that negligent data storage or password disclosure to third parties is their own responsibility and they bear full liability if third parties gain access to their Registered User or Service Provider account and undertake any obligations. Medisoma Ltd. is not obliged to verify the identity of Registered Users or Service Providers.
Understand and agree that Medisoma Ltd. will process and manage their personal data in accordance with the laws of the United Kingdom, including these Terms and Conditions and the Privacy Policy.
Registered Users and Service Providers undertake to:
Provide accurate and complete information about themselves.
Use only the information and data (including any intellectual property) that they have the right to use.
Safeguard their login password (if provided to Registered Users or Service Providers) in a manner that prevents third parties from learning it, except for individuals authorized by the Registered User or Service Provider to use the Portal on their behalf.
Promptly make any necessary updates to their information, such as in the event of a lost or changed contact telephone number or email address.
If it is determined that a Registered User or Service Provider is using information that they do not have the right to use and/or such information may potentially infringe upon the rights of third parties, such person will be notified by the Portal owner or the publication of such information may be suspended if such measures are necessary to reduce the negative consequences. The Portal owner has the right to make decisions in this regard, and Registered Users and Service Providers will not make any claims against the temporary suspension or removal of information from the Portal.
Registered Users have the right to:
Create a Service Provider page on the Portal. By creating a Service Provider page, the Registered User becomes a Service Provider and is subject to all these Terms and Conditions regulating the rights and obligations of Service Providers.
Submit a general request to Service Providers who, according to the Portal’s rules, will have the right to contact the submitting user directly and seek to enter into an agreement for the desired services.
Portal visitors have the right to use the functionalities of the Portal and enter into a written agreement with a Service Provider through the Portal’s system. The Portal does not become a party to such an agreement and assumes no obligations towards any party to such an agreement.
Rights and Responsibilities of the Service Provider, Requirements for the Service Provider’s Page:
The service provider confirms that they have the right to provide services and pay the appropriate taxes.
The service provider undertakes to:
Adhere to all Portal rules.
When providing services through a legal entity, the service provider must register on the Portal only on behalf of the represented trademark owner, legal entity owner, or authorized representative.
Post information and provide only those services that are not prohibited in the United Kingdom.
In the service provider’s page gallery, only upload photos and videos related to the service provider’s category/services. It is prohibited to upload erotic, pornographic, racist, hateful, aggressive, violent, offensive, immoral, illegal, or similar photos and videos. This rule also applies to the profile picture. A service provider page that fails to comply with these requirements may be blocked or hidden without a separate warning by the Portal owner, and all information about the service provider and their violations may be forwarded to competent law enforcement authorities.
Post only informative content in the appropriate sections that comply with linguistic standards.
Not register other service provider pages if the data matches an already registered service provider page: same category, same service description.
Provide objective, accurate, comprehensive, and detailed information about the services offered and the service provider’s competence.
Ensure the confidentiality and protection of the received client data and do not use it for any purposes other than providing services. Information about the client and the provided services must be deleted after the services have been properly provided unless the laws or an agreement with the client require otherwise.
Compensate the Portal or the client for any damages caused by improper use of the Portal or provided services or in other cases arising from the service provider’s fault.
The service provider is prohibited from:
Providing misleading, compromising, or offensive information about other individuals or entities that could cause direct or indirect harm to the Portal owner, other individuals, or entities. Individuals providing false (harmful) information bear full responsibility for the potential consequences arising from the submission of such information and are directly accountable according to the laws of the United Kingdom.
Sending or transmitting content, links to content, or any other form of content that is prohibited or restricted by the laws of the United Kingdom via email, electronic means, or any other method. It is also prohibited to use them for commercial or direct marketing purposes or to provide such opportunities to third parties (unless consent has been obtained), except when the information is provided in response to a general inquiry or another expressed need for a service.
The service provider has the right to:
Create multiple service provider pages on the Portal.
Remove their service provider pages from the Portal; however, the Portal is not obliged to provide the possibility to restore deleted information.

Rights and Obligations of the Portal
The portal has the right, at its discretion, to restrict or terminate the rights and access of the Registered User or Service Provider to use the Portal, including any information provided by the Visitor, Registered User, or Service Provider, by modifying, deleting, removing the Service Provider’s page, and prohibiting the Registered User or Service Provider from re-registering on the Portal if the Registered User or Service Provider:
Violates these Terms and fails to comply with their obligations as stipulated herein.
Provides false, incomplete, or misleading information during registration or while using the Portal.
Intentionally spreads fraudulent or inaccurate information on the Portal, insults other individuals, or engages in behavior that, in the opinion of the Portal owner, is inappropriate.
Receives negative complaints regarding service quality, improper service, or other reasons, which are considered negative feedback.
Represents legal entities, trademarks, or other businesses without proper authorization.
The portal has the right (but not the obligation) to monitor the actions of Registered Users and Service Providers on the Portal at any time. Using lawful means, the Portal owner has the right to investigate any violations of the Terms and take action to protect the rights and interests of other individuals.
The portal has the right, at any time and for any reason, to remove a person’s registration from the Portal and any information provided by the Registered User or Service Provider, as well as any records made by them from its database if, in the opinion of the Portal owner, it violates these Terms, applicable laws, or goes against good morals.
The Portal owner has the right to contact the relevant authorities to hold individuals accountable for unauthorized actions that cause material (including loss of income) and non-material damage to the Portal owner, its partners, clients, or other individuals and entities. The Service Provider will be notified of the decision to terminate the provision of services and informed of the reasons for such a decision via the provided contact email no later than 30 days in advance. This notification period does not apply if the Service Provider repeatedly violates the Terms, infringes upon the rights of others, or in cases provided for by other applicable laws, resulting in the termination of service provision. In such cases, the Portal immediately informs the Service Provider of the reasons for such a decision via email.
The Registered User is informed about the sanctions that will be imposed for a violation of the Terms through the email provided during registration. In case of a violation of the Terms, any ordered services will be canceled.
The Service Provider agrees that the Portal has the right to use all of the Service Provider’s information (text, graphics, images, etc.) in all promotional materials of the Britankes.co.uk Portal, such as social media platforms, newspapers/magazines, other websites, advertising boards, etc. The Service Provider’s information is used exclusively for promoting and publicizing the services of the Service Providers on the Britankes.co.uk Portal. If the Visitor does not agree with this condition, they do not have the right to register on the Britankes.co.uk Portal.
Furthermore, the Portal owner has the right to place the Portal’s logo, “Britankes.co.uk,” on the photos uploaded by the Service Provider on the Portal and when publishing the Service Provider’s photos for advertising and informational purposes.
The Portal owner has the right, at any time and at its discretion, to:
Modify or restructure the information provided by the Registered User or Service Provider on the Portal to enhance user convenience and/or ensure more efficient use of Portal functions.
Delete Reviews by Visitors, Registered Users, and Service Providers on the Service Provider pages if, within 6 months of submitting a Review, no new negative Review has been posted, or if at least 3 positive Reviews have been posted following a negative Review.
Terminate Portal activity without prior warning to Visitors, Registered Users, and Service Providers.
Perform necessary maintenance work on the Portal, which may restrict or terminate the provision of services for a reasonable period. In such cases, the Portal may, but is not obliged to, extend the provision of services to the Client for the period in which services were not provided or provide equivalent services free of charge (if the services are not of a continuous nature).
Personal Data Submission
The personal data of Visitors, Registered Users, and Service Providers are collected, provided, and processed in accordance with the requirements of the legislation of the United Kingdom and the Privacy Policy of the Britankes.co.uk portal.
Intellectual Property
All intellectual property rights to the Website and its content, including copyrights, industrial intellectual property rights, trade names, know-how, and commercial and production secrets, belong to the Portal or are lawfully used by the Portal through rights granted by third parties.
All rights to the Website and its creations are protected. The Registered User and Service Provider agree that publications and other information submitted by the Registered User or Service Provider, including any intellectual property, become part of the Portal’s database, are stored by the Portal owner or its authorized persons, and are used in accordance with the laws. The Portal owner, when using information about Registered Users, Service Providers, and third parties, as well as the information published about them, is not obligated to pay any royalties or compensation to the Registered User or Service Provider for the use of such content.
Service Providers on the Portal must provide only material for which they have the copyrights or material for which they have acquired the right to use by other means. When submitting material, the Service Provider is considered to have given consent to the Portal owner to store, distribute, and publish such material electronically and in other ways.
From the moment the Registered User or Service Provider submits information (makes a request, creates a page, or provides information to the Portal owner), the Registered User or Service Provider grants the Portal owner, free of charge, perpetual, and worldwide, to the maximum extent permitted by law, the following exclusive rights to all published content:
The right to reproduce, publish, publicly disclose, make publicly accessible, and distribute the posted information or its part by selling, renting, lending, providing for use, or otherwise transferring ownership.
The right to modify or adapt, or create derivative works.
The right to use the posted information in any other manner or form.
Responsibility
The Visitor, Registered User, and Service Provider agree that the Portal owner is not and will not be responsible for any malfunctions of the Portal or Services that occur without the fault of the Portal owner, and therefore, the Portal owner is not liable for any losses or damages incurred by the Visitor, Registered User, Service Provider, or third parties.
The Portal owner is not responsible for the quality, quantity, and completeness of services purchased or acquired through the use of the Portal and Services. The Portal owner is not responsible for the accuracy of advertisements for products and services of other physical/legal persons presented on the Portal, the quality of those products and services, or for the consequences arising from the use or non-use of their advertisement.
The Visitor, Registered User, and Service Provider understand and agree that the Portal and Services are provided without any additional confirmations or warranties from the Portal owner that the Portal will function properly, that the Services will be provided adequately and in a timely manner, without disruptions, and that they will meet the expected scope, and that it will not have any adverse effects on the Visitor, Registered User, Service Provider, or third parties. The Portal owner is not and will not be responsible for the unlawfulness, inconsistency, inaccuracy, or falsehood of the information on the Portal (except for the information provided by the Portal owner) and the negative consequences arising from it for the Visitor, Registered User, Service Provider, or third parties.
The Portal owner is not responsible for any damage and/or losses that may be incurred by the Visitor, Registered User, or Service Provider while using the Portal and Services, as well as when sending, hosting, and in any other way making any information publicly accessible.
The Visitor, Registered User, and Service Provider understand and agree that the Portal owner, considering these Terms, will never be responsible for all or any of its actions or omissions related to the Visitor’s, Registered User’s, or Service Provider’s use of the Portal and Services and compliance with these Terms.
The Visitor, Registered User, and Service Provider assume full responsibility for any compensation for damages or losses of any nature that may arise for them or third parties in any way while the Visitor, Registered User, or Service Provider uses the Portal or Services or the information contained therein.
The Visitor, Registered User, and Service Provider undertake to ensure that the Portal owner is never subject to any legal liability, or obligation to pay, reimburse, or otherwise compensate for any losses, damages, or other expenses arising from the Visitor’s, Registered User’s, or Service Provider’s use of the Portal and Services.
Legal Disputes
These Terms and Conditions are governed by the laws of the United Kingdom, including England and Wales, and any disputes arising from these Terms and Conditions will be resolved in the courts of the United Kingdom.
These Terms and Conditions come into effect once the Visitor confirms their acceptance of them and remain valid for the entire duration of the relationship between the Registered Visitor or Service Provider and the Portal.
All communications and information between the User and the Portal will be conducted electronically.
